1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Jivanta Wellness ("we," "us" or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

You agree that by accessing the Site and/or joining our MLM network, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Eligibility

To use our services and join as a distributor, you must meet the following criteria:

• You must be at least 18 years of age to register and participate.
• You must provide accurate, current, and complete KYC information (Aadhaar & PAN) as required by our policy.
• You must have the legal capacity and agree to comply with these Terms and Conditions.
• You must not be a resident of any country where MLM or network marketing is legally prohibited.

3. User Account Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

• You are responsible for safeguarding the password that you use to access the Service.
• You agree not to disclose your password to any third party.
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Purchases, Pricing & Payments

By placing an order, you agree to the following:

• Pricing: All prices are displayed in ₹ and are subject to change without notice.
• Payments: We use secure third-party payment gateways. By providing your payment information, you authorize us to charge your payment method.
• Shipping: Delivery timelines depend on your location. We are not responsible for delays caused by courier partners or natural disasters.
• Refunds: All purchases are subject to our Refund Policy.

5. MLM Compensation & Payouts

Our business operates on a Multi-Level Marketing (MLM) model. By joining, you agree to the following specific rules:

• Package Activation: Commissions are only generated when a package is activated using a valid PIN.
• Binary Matching: Binary matching requires at least 1 direct Left and 1 direct Right active member. A ratio must be matched to generate binary income.
• Wallet & Deductions: All commissions are credited to your platform wallet. A standard deduction of 2% TDS (Tax Deducted at Source) and 5% Admin Charge will be applied to all payouts.
• Withdrawals: Withdrawals are processed weekly. A minimum balance of ₹ 500 is required, and KYC must be verified.
• No Refund on Commissions: Once a commission is earned and credited to your wallet, it is final.

6. Prohibited Activities

As a user of the Site, you agree not to:

• Engage in any "spam" marketing or misleading claims to promote the opportunity.
• Violate any local, state, national, or international law regarding direct selling.
• Use the platform for money laundering, fraud, or any illegal activity.
• Attempt to hack, reverse engineer, or disrupt the security of the website.
• Manipulate the binary tree or use bot software to generate fake IDs.

7. Termination & Suspension

We reserve the right to suspend or terminate your account and MLM ID at our sole discretion, without notice or liability, if:

• You breach any of these Terms and Conditions.
• You fail to provide valid KYC documents.
• You are found engaging in unfair means to earn commissions.
• Your account remains inactive for a prolonged period (as defined by company policy).

Upon termination, any pending commissions may be forfeited, and you will lose access to your downline and dashboard.
